Halifax lawyer Lyle Howe reinstated after sexual assault conviction overturned

HALIFAX -- A Halifax defence lawyer whose conviction for sexual assault was overturned earlier this month has now been reinstated as a practising lawyer.

The Nova Scotia Court of Appeal ordered a new trial for Lyle Howe, who was sentenced last year to three years in prison for sexually assaulting a 19-year-old woman.

In an order posted on its website, the Nova Scotia Barristers' Society says that as of today its suspension of Howe has been lifted, with 37 conditions.

The society's complaints investigation committee says Howe must practise in a firm with at least two other lawyers, with one having 10 years' experience, and he's not allowed to represent anyone charged with sexual assault until his criminal case is dealt with.

Howe's law practice will also be subject to the supervision of a senior member of the bar appointed by the society and Howe will be responsible for the costs.

Howe applied to be reinstated following the Sept. 4 decision by the appeal court.
