York1 has officially withdrew its court application against Chatham-Kent. The court application was related to local planning requirements for the proposed landfill in Dresden. It argued the proposed project didn’t need local land-use planning or zoning approvals from the municipality. On Thursday, Chatham-Kent received an official Notice of Abandonment for the court application. The municipality says it anticipates that York1 will mot proceed through standard municipal planning approval processes. Those processes will be followed if a planning application is received by Chatham-Kent, leaving it up to council to approve. That could mean future public meetings will be held and an appeal to the Ontario Land Tribunal will be available.
