Highway hazard: OPP stop tractor-trailer missing full set of rear tires on Hwy. 17

Ontario Provincial Police say a driver is facing charges after they intercepted a commercial vehicle earlier this month, following reports of a tractor-trailer operating on Highway 17 with a significant mechanical defect.

Officers located the transport truck along the highway and discovered it was missing a full set of rear axle tires on its trailer.

OPP regional media and communications advisor Erin McCrea said the traffic stop occurred just before 11 p.m. CST in MacNicol Township on Feb. 10, in an email to CTV News.

Charges laid against driver, company

McCrea said that following the investigation, the driver — a 28 year old man from Winnipeg — was charged with failing to ensure a daily inspection report was accurately completed, driving a commercial motor vehicle with a major defect, and operating a commercial motor vehicle with a wheel separation.

The Winnipeg based company responsible for the transport was also charged with operating a commercial motor vehicle with a wheel separation.

Wheel separations pose serious danger

In a social media post about the incident, OPP emphasized the extreme danger posed by detached wheel assemblies.

“While it may sound surprising, this is not something you want to discover while driving behind it at highway speed,” police wrote.

“Each of these tire assemblies can weigh over 1,000 pounds. When they come off a commercial vehicle, they become an extremely serious hazard and can cause significant damage to property or vehicles, or result in serious injury or loss of life.”

Absolute liability under Ontario law

Under Ontario’s commercial vehicle safety requirements, wheel separations are treated with exceptional seriousness. The province has established an absolute liability law for such incidents, meaning operators and drivers can face penalties regardless of the cause. Fines for operating a vehicle with a wheel separation range from $2,000 to $50,000.

Highway safety is a shared responsibility

OPP used the event to remind the public of the importance of reporting unsafe vehicles.

“This incident serves as an important reminder to commercial drivers to complete thorough pre trip and en route inspections, and for all motorists to report unsafe vehicles — commercial or passenger — when something does not look right,” police said.

“Highway safety is a shared responsibility. If you see something concerning, call it in. It could prevent a serious collision and save lives.”
