Special Investigations Unit’s director Joseph Martino found York Regional Police officers not guilty of a criminal offence.

Police were summoned to a shelter in Newmarket about a woman causing a disturbance on New Year’s Day.

Police say the woman was refusing to leave the shelter even though she was in contravention of previous charges.

Police say during the arrest, the woman flailed and struggled as officers attempted to handcuff her.

More officers arrived and she restrained but taken to the hospital with what turned out to be a broken nose.

Martino determined the officer never struck the woman and the incident was more like a fall from a sofa to the floor.

He said he is satisfied with officer’s behaviour during the incident.
