A woman charged with careless driving causing death in a fatal crash last May in Sudbury will have her case return to court in September. Diane Leeson, 58, wasn’t in provincial offences court in Azilda on Aug. 4, the first time her case was dealt with in court. Leeson is charged in connection with the death of Havyn Winter Kay, 6, who was killed May 19 not long after she got off the school bus at Palace Place Co-op on Second Avenue in Minnow Lake. The family went public with their grief, and a fundraiser collected more than $54,000 to support them and help with the costs in the wake of the tragedy. Leeson is charged with careless driving causing death under the Highway Traffic Act and driving a vehicle while having cannabis readily available under the Cannabis Control Act. Sudbury police said at the time that the collision took place on private property within a residential parking area. Emergency personnel performed CPR and other lifesaving measures at the scene, but the young girl died of her injuries in hospital a short time later. The driver remained at the scene, police added. Leeson’s defence lawyer is Michael Haraschuk, who was represented at Tuesday’s hearing by a summer law student. The defence asked for six weeks for disclosure. The case will be back in provincial offences court Sept. 15.
