Goodfood Market hit by class action lawsuit over delivery fees

Goodfood Market is the subject of a class action lawsuit alleging that it concealed its delivery fees in the advertised price of its meal kits.

The lawsuit, filed in Quebec Superior Court last week, claims that the ready-to-cook meal company did not include the $5.99 delivery fee in the prices displayed on its website and mobile app.

However, the plaintiff, represented by the law firm Lambert Avocats, believes that delivery isn’t optional, since it’s impossible to pick up the order yourself. The delivery fee should therefore be included in the price displayed by the company, according to the petition.

He is asking the court to authorize a class action on behalf of all Quebec customers of the company who have made a transaction and paid delivery fees since Oct. 17, 2022.

The plaintiff’s arguments have not yet been tested in court.

The Montreal-based company’s response and the names of its lawyers are not yet listed in the Class Action Registry. It wasn’t possible to obtain an immediate response from Goodfood, which was contacted earlier in the morning.

The company is facing many challenges, having lost subscribers for several quarters. In August, the company announced the “immediate departure” of co-founder and CEO Jonathan Ferrari.
