Warning: This story contains details of alleged sexual violence against a minor. It was packed in a Calgary courtroom on Tuesday for the second day of sexual assault trial of a Sundre woman as jurors heard testimony from the teenage complainant in the case. Thirty-five-year-old Alexa Suitor pleaded not guilty to sexual assault with someone under 16 and sexual interference. The complainant, who was 15 years old at the time of the alleged offence and cannot be identified due to a publication ban, testified that he had sex with Suitor. “I felt a hand grab my butt,” the teenage boy told court. “She moved her hand away from my butt and went towards my penis. She grabbed it.” The complainant attended a New Year’s Eve party at a rural property northwest of Sundre. Court heard the alleged offence occurred there in the early morning hours of Jan. 1, 2024. He described the encounter to have lasted about six minutes. Court heard each was sleeping on separate cots in the living room, where several other minors were also sleeping. The complainant admitted to drinking alcohol that night, estimating he’d consumed around nine drinks. In a fiery cross-examination, defence lawyer Patrick Fagan accused the witness lying in front of the jury. The complainant said he received a Snapchat message several hours later that day from Suitor saying “we took it too far last night.” He agreed and removed her on Snapchat because “he didn’t want to talk to her.” During cross-examination, Fagan asked the complainant if the encounter occurred. “I did have sex with Alexa Suitor,” the complainant answered. “I touched Mrs. Suitor in a sexual manner. She definitely touched me in a sexual manner.” Suitor a chaperone at the party Through testimony, court heard neither Suitor nor the complainant lived at the property. On Monday, court heard those that lived in the home had discussed having Suitor as a chaperone for the teens when sleeping arrangements were made. Court heard the plan was to separate the boys and girls into different sleeping areas from the party. The complainant says police seized his phone for the investigation and still have it. The Crown’s third witness, who also attended the party and cannot be identified due to a publication ban, is expected to testify Wednesday. It’s unclear if the defence plans to call any witnesses. The jury trial is slated for 10 days.
