All evidence is in at dangerous driving causing death trial

The defence wrapped up its case on Tuesday claiming that 31 year Bahaa Ali wasn’t the one behind the wheel of his black Mercedes Benz.

The defence wrapped up its case on Tuesday claiming that 31-year-old Bahaa Ali wasn’t the one behind the wheel of his black Mercedes Benz when it crashed into a beige Hyundai Sonata at the intersection of Southdale and White Oak Roads on November 3, 2020.

Ali’s lawyer Melina Macchia recalled a number of Crown witness who already testified earlier in the trial.

They were asked if they were certain that the accused was the one driving his vehicle that day.

One of the witnesses, Colleen O’Brien, who called 911 that day, said the accused was by his car. “Someone asked him if he was okay as he was standing there rubbing his wrist.”

And while testifying on the stand, O’Brien looked at the accused in the courtroom and said, “He looks exactly like the person who was standing there.”

Ali has testified that it was his younger brother who crashed into the Hyundai that November day and that he told police it was he himself in an attempt to help his younger brother.

Forensic evidence during the trial revealed that the modified Benz reached speeds of up to 129 kilometres an hour in an area zoned for 60 kilometres an hour.

Joan Clubb, 68, of London was a passenger in the Hyundai. She would be rushed to hospital but later pronounced dead.

Closing arguments in the case are slated to be heard on November 20.
