ORANJESTAD, Aruba - A lawyer for a U.S. businessman detained in Aruba says he will appeal a judge's order detaining his client at least 60 more days in the presumed death of a travel companion.

Attorney Michael Lopez says he will appeal the decision by Monday's deadline. Lopez declined further comment Thursday, saying he is still studying the detention order for Gary Giordano.

The judge says authorities can hold Giordano as a suspect in the presumed drowning of 35-year-old Robyn Gardner.

Giordano says Gardner disappeared while snorkeling. But police say they found inconsistencies in his story and the Gaithersburg, Maryland, man has been jailed for nearly a month.

Lopez says there is no evidence of a crime. Gardner's body has not been found.
