A 65-year-old woman is facing three charges in connection with a car crash at a London, Ont., Costco that killed a young girl and injured her pregnant mom and sister.

London police announced Friday that Ruth Burger, of London, has been charged with one count of criminal negligence causing death and two counts of criminal negligence causing bodily harm.

Addison Hall, 6, died of her injuries two days after a car plowed through the front doors of a busy Costco on July 25. Hall’s sister, Miah Bozek, and pregnant mother, Danah McKinnon-Bozek, were among those injured in the crash.

McKinnon-Bozek’s baby was delivered by emergency C-section immediately after the crash. The infant, Rhiannon Bozek, was listed in critical condition and died on Aug. 1.

Police said Friday there were no legal grounds to charge Burger in connection with the infant’s death.

“The definition of the Criminal Code has some stipulations that a person becomes a person, essentially, when it is born from its mother in a living state," London police Sgt. Amanda Pfeffer said.

Three-year-old Miah remains in hospital in stable condition, while McKinnon-Bozek has since been released from hospital.

The vehicle that crashed through Costco's front doors while in reverse has undergone a number of "mechanical examinations," Pfeffer said.

Police earlier said that alcohol was not a factor in the crash.

Burger has been released from custody and is scheduled to appear in court on Sept. 16.
