FREDERICTON - Three New Brunswick mothers whose boys were killed in a school van crash in 2008 have failed in their latest efforts to block production of a movie about the aftermath of the tragedy.

Dream Street Pictures of Fredericton and CBC Television are planning a movie on how the Bathurst High Phantoms were able to win a provincial basketball title a year after the crash that killed seven players and the wife of their coach.

Isabelle Hains, Ana Acevedo and Marcella Kelly have complained about the use of CBC funding and a provincial film tax credit for the making of the movie.

However, the provincial and federal auditors general and the CBC ombudsman are refusing to intervene.

The women also sought to have acting provincial ombudsman Francois Levert (Leh-vair) block a decision to allow the use of the school for some of the filming.

In a response this week, Levert says their complaint should instead be directed to the District Education Council in Bathurst.
