VICTORIA - A judge has dismissed a lawsuit filed by the parents of Reena Virk against the B.C. government.

The judge concluded the Virks waited too long to bring the matter to trial after their 14-year-old daughter was beaten and drowned by a group of swarming teens in 1997.

Six teenaged girls were later convicted of assault and Warren Glowatski and Kelly Ellard were convicted of second-degree murder.

Ellard has gone through three trials and will appeal her latest conviction in the case in May.

Manjit Virk says the family never intentionally delayed taking the matter to court.

Reena's father says the family was waiting for all criminal cases, including Ellard's, to be dealt with.
