LHSC files $20M statement of claim over UH window procurement

London Health Sciences Centre has filed $20 million statement of claim against several defendants over large-scale window replacement project at University Hosp

London Health Sciences Centre (LHSC) has filed a multi-million dollar statement of claim against three companies and two people for alleged negligence.

The $20-million suit is in relation to a large-scale window replacement project at University Hospital as part of an internal investigation into past procurement practices.

The companies named in the statement of claim are JM Windows and Doors Supplier Inc. of London, Ont., HDR Architecture Associates Inc. of Kingston, Ont., and JM General Contracting of Scarborough, Ont. Individuals Vladislav Pavliuc of Toronto and Jaibarrat Danraj of Scarborough were also included in the statement.

LHSC Supervisor David Musyj issued a brief statement Tuesday afternoon. It read in part:

“While investigations are ongoing and so the full extent of the deficiencies remains unknown, LHSC has identified issues with the quality of the installation of the windows. These include a range of deficiencies, including water leaks and issues with gaskets, fasteners, sealant, and anchorage. We are continuing to work with external experts to assess these deficiencies in greater detail.”

Musyj added that there have been no safety issues related to the windows at the hospital to date. He went on to say LHSC is, “actively addressing issues as they arise while developing a longer-term remediation plan for the affected windows.”

In July, LHSC filed two civil lawsuits totaling $60 million against former employees and executives. The hospital claims there was a decade-long fraudulent procurement scheme where some of the defendants used money to buy real estate.

The second claim alleges the hospital’s former CEO and other top officials ignored the potential fraud.

None of the hospital’s three statements of claim have been tested in court.
