MONTREAL -- Canadian Pacific Railway is officially asking for permission to appeal the approval of the $430-million settlement fund for victims and creditors of the Lac-Megantic train derailment.
The company states in court documents obtained by The Canadian Press today that the fund is unfair and that the Superior Court justice who gave it the green light earlier this month had no jurisdiction to do so.
Justice Gaetan Dumas approved the fund, which was created when about 25 companies accused in the July 6, 2013, rail derailment that killed 47 people offered to compensate victims.
CP is the only company accused in the tragedy to not participate in the offer.
It is also contesting another one of Dumas' rulings tied to the settlement fund.
The court is scheduled to hear CP's two requests for appeal on Sept. 9 in Montreal.
